There appears to be an increase in SSO customers in June 2025 and a subsequent decrease in July 2025. Also, the SSO PLC values appear to be decreasing throughout June and July 2025. Can you please confirm that the SSO PLC data and SSO customer count data for June and July 2025 is correct?
The SSO PLC data as well as the SSO customer count data available on the Data Room page of the CBP website has been reviewed and is correct. AEP Ohio does not provide load analysis or forecast for SSO customers or SSO Load. Each bidder is responsible for its own independent assessment of all sources of information that may be pertinent and is responsible for making all investigations it deems necessary or advisable in its sole discretion before deciding to participate in any auction under AEP Ohio’s CBP.

What is the MW-measure of a tranche in the March 2026 Auction?
On January 6, 2026, during the webcast, the Auction Manager announced the MW-measure of each tranche and PLC (MW) to be 14.54 and 1,454, respectively. The PLC (MW) is based on the five highest coincident peaks experienced by PJM in 2025 for SSO customers (i.e., non-shopping only). The MW-measure is provided for reference purposes only. AEP Ohio does not represent that a tranche will have the load announced or any particular value. The amount of actual quantity to be delivered depends on many factors (e.g., migration of SSO customers). Bidders are responsible for evaluating the uncertainties associated with the SSO Load for which they are responsible for providing supply.

How should the Applicant complete Section 1.4 of the online Part 1 Form depending on whether the Applicant's Legal Representative in Ohio is an individual or a company?
An Applicant's Legal Representative in Ohio can be an individual or company that is authorized and agrees to receive service of process on the Applicant’s behalf.If the Applicant names a company as the Legal Representative in Section 1.4 of the online Part 1 Form, the name and the contact information of an individual from that company must be provided. This individual must be authorized to act on behalf of the company that will accept service of process on the Applicant’s behalf. The Applicant would then complete the Legal Representative Insert (#P1-4) by checking “yes” to indicate a company has been retained to accept service of process and complete Part A of the Insert. The individual from the company listed in Section 1.4 of the online Part 1 Form must sign the certification.Alternatively, if the Applicant names an individual as the Legal Representative in Section 1.4 of the online Part 1 Form, the name and the contact information of that individual must be provided. The Applicant would then complete the Legal Representative Insert (#P1-4) by checking “no” to indicate a company has not been retained to accept service of process and complete Part B of the Insert. The individual listed in Section 1.4 of the online Part 1 Form must sign the certification.

What are the pre-bid security requirements for the March 2026 Auction?
For the March 2026 Auction, each bidder must provide a pre-bid letter of credit or cash in an amount of $500,000 per tranche of the bidder’s indicative offer at the maximum starting price. A bidder that relies on the financial standing of a guarantor must, in addition to a pre-bid letter of credit or cash, provide a letter of intent to provide a guaranty in an amount of an additional $300,000 per tranche of the bidder’s indicative offer at the maximum starting price. A bidder that relies on its own financial standing and does not have sufficient unsecured credit must, in addition to a pre-bid letter of credit or cash, submit a letter of reference in an amount of an additional $300,000 per tranche of the bidder’s indicative offer at the maximum starting price. A bidder always has the option of increasing the amount of the pre-bid letter of credit or cash to $800,000 per tranche rather than providing a letter of intent to provide a guaranty or a letter of reference.

Can I access historical data on the Data Room page of the CBP website?
Historical hourly energy data is available in the Archives matrix on the Data Room page of the CBP website. The Data Room is available for public use and contains the most up-to-date information available for the data series that are updated monthly, on or before the 20th of each month. An agreement with AEP Ohio is not required to access the Data Room.

Are the indemnification provisions in the Master SSO Supply Agreement applicable to acts or omissions of the SSO Supplier only?
The provisions of the Master SSO Supply Agreement are approved by the Public Utilities Commission of Ohio and can not be modified by AEP Ohio. More specifically, the Indemnification provisions speak for themselves, as both SSO Suppliers and SSO Supplier are used within the indemnification provisions. Additionally, indemnification claims can also be fact or circumstance related, so AEP Ohio is not going to provide a response to a bidder question purporting to limit the terms of the indemnification provision as written.

If termination occurs under Section 2.4 of the Master SSO Supply Agreement, do the terms similar to those under Section 2.3 Early Termination apply?
The language of Section 2.4 of the Master SSO Supply Agreement does not reference “unforeseeable event”. The first sentence of Section 2.4 states: “Notwithstanding anything in this Article 2 to the contrary,…”. This language makes clear that Section 2.3 Early Termination or settlement methodology does not apply if the termination is based on Section 2.4.

Does the Master SSO Supply Agreement include a waiver of jury trial provision?
The terms of the Master SSO Supply Agreement are established and approved through the Public Utilities Commission of Ohio, in connection with the Electric Security Plans submitted by AEP Ohio. The Master SSO Supply Agreement does not include a waiver of jury trial provision, as the waiver of jury trial provision is only applicable to Attachment D (Form of Guaranty) that a bidder’s ultimate parent company would provide. AEP Ohio does not make changes to the Master SSO Supply Agreement for individual suppliers.
